(1) These General Terms and Conditions apply to contracts regarding the rental of vacation apartments for accommodation as well as all other services and deliveries provided to the guest by may:home Apartments - Janine May & Johannes Schubert. The services of may:home Apartments - Janine May & Johannes Schubert are provided exclusively on the basis of these General Terms and Conditions.
(2) Subletting or re-renting the provided vacation apartment, as well as its use for purposes other than residential accommodation, requires our prior written consent.
(3) Terms and conditions of the guest shall only apply if they have been agreed upon in advance. Deviations from these conditions are only effective if we have expressly confirmed them in writing.
§ 1 Definitions
a) The term "may:home Apartments", "we", "us", or "our" refers to may:home Apartments - Janine May & Johannes Schubert, private rental of vacation apartments by Janine May & Johannes Schubert.
b) The term "may:home Apartments" refers to our website https://mayhome-apartments.bookingturbo.com/de
c) The term "Services" refers to all services provided by may:home Apartments – Janine May & Johannes Schubert from time to time, including, but not limited to, receiving booking information via our booking and payment system, managing reservations and payments, responding to customer inquiries via our reservation system, and managing content on third-party channels via our channel manager.
d) The term "Customer" refers to either: a) the individual registering for a customer account on their own behalf; or b) the organization on whose behalf the individual registers for a customer account.
e) The term "Customer Account" refers to the account created by the customer on https://mayhome-apartments.bookingturbo.com/de to access and use the services.
f) The term "Property" refers to any form of accommodation, building, houseboat, apartment, room, apartment blocks, houses, or other residential or rental spaces displayed by the customer or a third-party channel and offered for rent via the services.
g) The term "Content" means text, graphics, images, music, software, audio, video, information, or any other form of data.
h) The term "Customer Content" refers to content provided by the customer as part of using the services, including, but not limited to, other information.
§ 2 Booking/Booking Confirmation
All booking requests must be made via our website https://mayhome-apartments.bookingturbo.com/de, by e-mail at mayhome.apartments@gmail.com, via third-party providers, or by phone at +49 172 8844081. Any requests made via any other method, such as Facebook or Instagram, will not be considered. If we can offer you the vacation apartment for your requested period, we will send you a written confirmation and the invoice via e-mail. Upon receipt of the booking confirmation and after the deposit has been paid (see § 3 Payment Conditions), your booking becomes legally binding.
§ 3 Payment Conditions
Your booking becomes valid upon receipt of the deposit. The deposit of 50% of the rental agreement total is due for payment within 7 days after receiving the booking documents. Following the successful deposit payment, the remaining balance becomes due 30 days prior to the arrival date. If the payment deadlines are not met, may:home Apartments may withdraw from the contract. Non-payment shall be deemed a cancellation and entitles us to re-rent the property. Additional costs for water, parking space, energy costs, and waste disposal are not charged.
§ 4 Arrival and Departure
On the day of arrival, the vacation apartment is available from 3:00 PM. Upon arrival, the key will be left in the designated key box. The guest will receive instructions for the key handover 1 day before arrival by phone or e-mail. Claims for damages cannot be asserted if, in exceptional cases, the vacation apartment cannot be occupied punctually at 3:00 PM. On the day of departure, the apartment must be vacated by 10:00 AM. If the guest wishes to request a late check-out, this must be arranged with us in advance. A late departure without prior arrangement will be invoiced. If the guest does not appear by 11:00 PM on the day of arrival, the contract shall be deemed terminated after a period of 24 hours without notification to may:home Apartments. may:home Apartments or our representative may then freely dispose of the property. A (proportionate) refund of the rent due to early departure will generally not be issued. The apartment must be left swept clean on the day of departure. Dishes, glasses, etc., must be cleaned and put away, and the refrigerator must be emptied. If the apartment is not left in the required condition, you may be billed for extra cleaning.
§ 5 Vacation Apartments
The vacation apartment is handed over by us in a neat and clean condition with a complete inventory. Should you notice any defects during your stay, the guest is obliged to inform may:home Apartments immediately. The guest is liable for damages caused by them to the rental property and its inventory, e.g., broken dishes, damage to the flooring, or damage to the furniture. This also includes the costs for lost keys. The inventory must be treated with care and consideration and is only intended to remain inside the vacation apartments. Rearranging items of furniture, especially beds, is prohibited. The guest is also liable for the faults of their fellow travelers. Damages resulting from force majeure are excluded from this. In the event of breach of contract regarding the use of the vacation apartment, such as subletting, overcrowding, disturbing the peace of the building, etc., the contract can be terminated without notice, and the guest must leave the vacation apartment. The rent already paid will remain with may:home Apartments.
§ 6 Pets
The accommodation of pets of any kind is prohibited in the vacation apartment.
§ 7 Stay
The vacation apartment may only be used by the persons listed in the booking. If the apartment is used by more people than agreed upon, a separate fee of 100 euros per night must be paid for each additional person. In this case, may:home Apartments also reserves the right to terminate the contract without notice. Subletting and transferring the apartment to third parties is not permitted. The guest declares their agreement with the General Terms and Conditions as well as the house rules of the vacation apartments. This agreement is formalized upon making the payment. In the event of violations of the GTCs (AGB) or the house rules, may:home Apartments is entitled to terminate the rental agreement immediately and without notice. No legal claim to a refund of the rent or compensation exists.
§ 8 Cancellation by the Guest
In the event of a cancellation, the guest is obliged to pay a portion of the agreed price as compensation. Cancellations must be made in writing. The amount of compensation depends on the remaining time until the arrival day and is calculated as follows: up to 30 days before the arrival day 50% of the agreed price; up to 6 days before the arrival day 75% of the agreed price; <5 days before the arrival day or non-arrival 90% of the agreed price.
§ 9 Cancellation by the Host
In the event of a cancellation on our part due to force majeure or other unpredictable circumstances (such as an accident or illness of the hosts) as well as other circumstances beyond our control that make fulfillment impossible, liability is limited to the refund of costs. In the event of a justified cancellation, the customer has no claim to damages – no liability is assumed for travel or hotel costs. A cancellation by may:home Apartments can take place after the start of the rental period without observing a notice period.
§ 10 Liability of the Host
may:home Apartments is liable within the scope of its duty of care for the proper provision of the rental property. Liability for possible failures or disruptions in the water or electricity supply, as well as events and consequences resulting from force majeure, are hereby excluded.
§ 11 Permission to Use Internet Access via Wi-Fi
may:home Apartments maintains internet access via Wi-Fi in its vacation apartment. It permits the guest to share the use of the Wi-Fi access to the internet for the duration of their stay at the holiday property. The renter does not have the right to permit third parties to use the Wi-Fi. may:home Apartments does not guarantee the actual availability, suitability, or reliability of the internet access for any purpose. It is entitled at any time to permit further co-users for the operation of the Wi-Fi in whole, in part, or temporarily, and to restrict or exclude the renter's access in whole, in part, or temporarily if the connection is or was used unlawfully, provided that may:home Apartments must fear liability as a result and cannot prevent this with reasonable effort in a timely manner. In particular, may:home Apartments reserves the right, at its sole discretion and at any time, to block access to certain pages or services via the Wi-Fi (e.g., pages glorifying violence, pornographic content, or pages subject to a fee).
§ 11.1 Access Data
The use of the Wi-Fi is carried out by means of access protection. The access data (login and password) must under no circumstances be passed on to third parties. If the guest wishes to grant third parties access to the internet via the Wi-Fi, this is strictly dependent on our prior written consent and the documented acceptance of the provisions of this usage agreement by the third party via signature and full identity details. The guest undertakes to keep their access data secret. may:home Apartments has the right to change access codes at any time.
§ 11.2 Risks of Wi-Fi Usage, Limitation of Liability
The guest is advised that the Wi-Fi only enables access to the internet; virus protection and firewalls are not available. The data traffic generated using the Wi-Fi is unencrypted. Therefore, the data may potentially be viewed by third parties. may:home Apartments expressly points out that there is a risk that malicious software (e.g., viruses, Trojans, worms, etc.) may get onto the end device when using the Wi-Fi. The use of the Wi-Fi is at the guest's own risk and peril. We assume no liability for damage to the renter's digital media caused by the use of the internet access, unless the damage was caused intentionally or through gross negligence by us and/or our vicarious agents.
§ 12 House Rules, General Rights and Obligations
(1) The guest is obliged to comply with the house rules. Night rest applies from 10:00 PM to 7:00 AM. To avoid disturbance, TV and audio devices must be set to room volume.
(2) For the duration of the vacation apartment rental, the guest is obliged to keep windows (except tilted open) and doors closed when leaving the vacation apartment.
(3) A general smoking ban applies inside the vacation apartment. In the event of non-compliance, you may be charged a cleaning fee of up to 200 euros. Smoking is only permitted on balconies and terraces.
(4) In the underground garage, we offer guests the free parking space number 29. The use of other parking spaces on the residential estate or in the underground garage at Hofer Str. 23 is prohibited. Additional vehicles can be parked along Hofer Straße. Please ensure that no vehicles obstruct the underground garage exit.
(5) The use of the children's playground is permitted for children from 0 years of age and is at one's own risk. Parents are liable for their children.
(6) The introduction and/or attachment of materials for decoration or similar is not permitted in the vacation apartment. The guest is solely liable for decorations or similar introduced and/or attached regardless. The guest is furthermore obliged to compensate for damages caused by the introduction and/or attachment of decorations or similar.
(7) may:home Apartments has a right of access to the vacation apartment at any time, particularly in the event of imminent danger. Reasonable consideration must be given to the guest's protectable interests when exercising the right of access. We will inform the guest in advance about exercising the right of access, unless this is unreasonable or impossible under the circumstances of the individual case.
(8) The key to the apartment is part of a master key system. If the key is lost, the replacement and the labor effort by a specialist company will be invoiced. This will be calculated according to current actual costs. In the event of a lost key, costs of approximately EUR 20,000 are to be expected. To prevent key loss, the key is equipped with a GPS tracker. Tracking of the key will only be carried out in the event of loss and serves to protect the renter.
(9) A noise level sensor is installed in the hallway of the vacation apartment. This measures the volume (in decibels) inside the apartment and serves to protect the neighborhood from parties or more than the booked number of guests.
§ 13 Place of Jurisdiction
For any disputes arising from the contractual relationship, the District Court (Amtsgericht) of Chemnitz shall have jurisdiction.
